Getting arrested in Delaware County

Delaware County has 49 municipalities, and many of them run their own police department. Upper Darby, Haverford, Radnor, Springfield, Ridley and Marple each have their own officers, training and habits. A DUI stop in Upper Darby and one in Radnor can look very different on paper, and those details matter when we review a case.

Most arrests we see here come off I-95 near the airport, I-476, Route 1, West Chester Pike, Baltimore Pike and MacDade Boulevard. Because Delco borders Philadelphia, we also represent a lot of Philadelphia residents who were stopped just over the city line and now have to deal with a suburban court they have never seen.

What happens next

If you are not released after arrest, you may be held at the George W. Hill Correctional Facility until bail is set. Most DUI cases, though, start with a summons in the mail. Your first real court date is the preliminary hearing at the magisterial district court that covers where you were stopped. If the case is held for court, it goes to the Delaware County Court of Common Pleas in Media.

For first-time DUI and some other first offenses, Delaware County offers ARD. Getting in is up to the District Attorney, and a clean, complete application helps. When ARD is not available, the defense starts with the stop: why the officer pulled you over, how the field tests were done, and whether the breath or blood test was handled correctly.

What is different about Delaware County

  • Dozens of separate police departments means arrest reports, video and testing practices vary from town to town.
  • Arrests near the Philadelphia line often involve out-of-county drivers who do not know the Media courthouse.
  • Several colleges, including Villanova, Swarthmore and Widener, mean a steady stream of under-21 and first-offense cases.

You work directly with attorney John Gentry from the first call to the last court date. Your case is not handed off to someone you have never met.

At 201 West Front Street in Media. Court of Common Pleas cases, including DUI and most criminal charges, are heard there. Preliminary hearings are held first at local magisterial district courts.

Many first-time offenders qualify. The District Attorney decides. An accident with injury, a child in the car or a prior ARD can rule it out. We review eligibility at the first consultation.

You need a lawyer who handles Delaware County cases. The procedures, the courthouse and the ARD program are different from Philadelphia's. We handle Delco cases regularly.

Most take a few months from arrest to resolution. ARD cases often move faster. Blood test results, court scheduling and whether the case goes to trial all affect the timeline.
